General terms and conditions for Bionomie workshops, courses and training

Article 1. Preliminary provisions.
In these general terms and conditions, the following terms have the following meaning:
Bionomie: bionomie vof, established in Roosendaal, Jagersberg 38, registered in the Trade Register of the Chamber of Commerce in Breda under number: 62496379
Workshop, course or training agreement: the agreement that is concluded at the time of written registration by the participant for a workshop, course or training of Bionomy. As a result, Bionomie undertakes to provide the participant with a workshop, course or training offered by Bionomie and organized by them.
Participant: the party with whom Bionomie has concluded a workshop, course or training agreement, which is subject to these general terms and conditions.
The general terms and conditions apply to all offers and agreements in which Bionomie acts as a trainer, workshop or course organizer or contractor.

Article 2. Conclusion and content of the agreement.
Before an agreement can be concluded, the participant must have read the disclaimer and the general terms and conditions of Bionomie.
The agreement is concluded when the participant registers for an offer from Bionomie.
Registration takes place in writing via email or via the registration form on the agenda of this website.
After registration, the participant will receive a confirmation of registration by email.
The participant, who also books a workshop, course or training on behalf of other participants, is jointly and severally liable for all other (co -) participants that he/she registers.
When registering/by a minor, written consent of the legal representative is necessary.

Article 3. Payment.
Payment is made before the workshop, course or training begins.
The registration is final when the full course amount has been credited to Bionomie's account.

Article 4. Changes by Bionomy.
Number of participants
Bionomie has the right to cancel or postpone the workshop, course or training agreement to a later date, if one week before the start of the workshop, course or training the number of registrations is less than the required minimum number of participants. In the event of a shift, the new date will be determined in consultation with the already registered participants.
Should this occur, one has the right to cancel without charge, provided that this is communicated to Bionomie within 7 days after notification.
Important circumstances or force majeure
If important circumstances or force majeure give rise to this, Bionomie reserves the right to make changes to the program.
There is force majeure in the event of abnormal and unforeseeable circumstances, the consequences of which could not be avoided despite all precautions.
Important circumstances are circumstances that are of such a nature that further Binding of Bionomie to the agreement cannot reasonably be required. Any resulting damage will be settled as follows:
If the change can be attributed to the participant, the resulting damage will then be borne by the participant.
If the cause of the change can be attributed to Bionomie, the resulting damage will be borne by Bionomie.
If both parties are to blame for the change, both parties each bear their own damages.

Article 5. Liability.
Bionomie accepts no liability for personal injury or damage to property of participants, nor any liability resulting from events during the workshop, course or training.
Compensation
If the workshop/course does not proceed in accordance with the expectations that the participant could reasonably have under the agreement, the participant is obliged to report this to Bionomie as soon as possible.
Any damage will be compensated by Bionomie unless the shortcoming in the performance is not attributable to Bionomie nor to the person / organization whose help / cooperation in the execution of the agreement is used, because:
The shortcoming in the performance of the agreement is attributable to the participant.
The shortcoming in the fulfilment of the agreement could not be foreseen or could not be remedied and/or that it is attributable to a third party who is not involved in the delivery of the workshop, course or training (See also Article 4, important circumstances).
The shortcoming in the performance of the agreement is due to force majeure (see Article 4): an event that could not be foreseen or remedied by Bionomie or the person whose assistance is used in the performance of the agreement, with all possible care.
If the workshop/course does not proceed in accordance with the expectations that the participant could reasonably have under the agreement due to circumstances that are neither attributable to the participant nor to Bionomy, each bears his own damage.
If Bionomie is liable for loss of workshop - course - or training enjoyment, the fee is not more than once the workshop/course sum.

Article 6. Obligations of the participant
You are not entitled to hand over course material to third parties in any way or to give it to third parties without permission from Bionomie.
The participant who creates such a nuisance or burden that a proper execution of a workshop, course or training is thereby complicated can be excluded from the workshop, course or training by Bionomy. All resulting costs will be borne by the participant.

Article 7. Cancellation and substitution.
Of course, it may happen that the participant has to cancel the booked workshop, course or training. If you wish to cancel a registration, the following rules apply:
In case of cancellation up to 14 days before the start of the course, the full course amount will be refunded. After that, no refund is possible;
Participation in the course at a later date is possible;
A substitute may be sent at any time;
If one stops participation in whole or in part after the start of a course, one is not entitled to any reimbursement of the course costs;
A cancellation must always be made in writing by letter or e-mail. The date of the postmark or e-mail date is assumed.

Article 8. Complaints handling.
An identified shortcoming in the implementation of the agreement must be reported to Bionomie as soon as possible so that it can find an appropriate solution.
If a shortcoming is not satisfactorily resolved, it must be submitted to Bionomie in writing and with reasons no later than one month after the end of the workshop, course or training. You will receive a written response within 30 days.

Article 9. Changes To Terms And Conditions
Bionomie reserves the right to change or supplement these general terms and conditions.
Changes also apply to agreements already concluded with due observance of a period of 30 (thirty) days after publication of the changes on the Bionomie website or by electronic notification.
Minor changes can be made at any time.
If the participant does not want to accept a change in these conditions, he can dissolve the agreement until the date on which the new conditions come into force.
